Transfer of undertakings

Transfer of undertakings

Are you buying or selling a business?  Have you factored employment liabilities into the price?

When you buy or sell a business, you may have to undergo the process of transferring staff. The transferring of staff from one organisation to another is both challenging and complex for all parties in order to ensure you follow the rules set by the Transfer of Undertakings, (Protection of Employment) Regulations 2006 (TUPE). TUPE is a complex piece of legislation and often an area which employers neglect.

Whether you’re involved in an acquisition, disposal or outsourcing agreement, TUPE provides your employees with the right to be informed and consulted in relation to the transfer of their employment, as well as giving them certain protection from dismissal or changes to their terms of employment.

We are able to assist in guiding you through this process at any stage or before the transaction occurs in order for you to be prepared.
