School holidays are here- act now!

In an ideal world separated parents agree that in spite of the breakdown of their relationship both would continue to play an active role in their children’s lives.
Unfortunately, this is not always the case.

With the school holidays upon us thought must be given to agreeing when you can take the children on holiday. You may be committing a criminal offence, if you are separated and take the children on holiday without the other parents consent.

Where both parents have parental responsibility for the children, it is necessary for each to obtain the agreement of the other, before taking the children abroad, even on a day trip to Euro Disney. This is not generally the case where children are taking a holiday within the United Kingdom; however it is preferable to have the holiday agreed.

You may already enjoy regular contact with the children however this does not mean that additional holiday contact will be agreed. If not agreed an application to the court will need to be made and a hearing may be necessary. If the matter still cannot be agreed the court can take the issue out of the party’s hands and make a final decision. The court process takes time which is why action must be taken now otherwise the planned wonderful holiday will be missing a vital ingredient, the children.
